Help removing judgement off credit report that violates Soldier's and Sailor's Civil Relie

My fiance and I are trying to get a VA mortgage. The only thing holding us back is a judgment rendered in 06. The judgement came from when he was in basic training and he left his rent money with his roommate. The roommate stole the money and abandoned the apartment. As a result my fiance was evicted and a judgement was rendered against him for 1032 dollars. This was all done during the time he was in basic training. What can we do to take care of this, as it is illegal to render a judgement against someone on active duty or to evict someone on active duty if rent is below 1200 dollars per month.We%26#039;ve already talked to the mortgage company. I%26#039;m desperate!

You might need to read the Act from 06 but I know they have rewritten it now so that it is for deployed soldiers not active duty soldiers. I would set up an apt at the JAG office and go talk to them about it they would have the best advice.

Banks rule this country. Why do you think you are judged by what you did to a bank or a business? Because they own this country. Now I would say the only way around this would be to contact the company that you owe the 1032 to and try to set up payments with them to pay it off. Maybe you can pay if off in a few months. Try to be honest with them and ask them to take this off your record when you start paying them back.

Also, assuming your fiancee is still active he should talk to the base legal office about this. The other thing you should be able to do is talk to YOUR attorney that is doing your real estate deal....I assume you are using an attorney?



IF you are not, you should be! Anytime buying or selling a home, hire a real estate attorney, the best 400.00 +/- a few bucks you will ever spend, and they can and will help you with things like this!

Well most of the changes to the Soldier%26#039;s and Sailor%26#039;s Civil Relief Act dealing with Judgements and evictions, were made after 2006.



But as you know, you still must pay the bill,

Have you even tried ?



If you owe the money, the Soldier%26#039;s and Sailor%26#039;s Civil Relief Act will not prevent them from putting it on your credit report.



Even the new Soldier%26#039;s and Sailor%26#039;s Civil Relief Act would not prevent that.



The law would prevent them from doing so, while the service member is deployed.



But your talking about an unpaid debt from two years ago.



So go pay the debt.

Don%26#039;t worry!! As a Naval Officer and banking professional, I know several avenues you and your fiance can take. The easiest is to have your fiance get a copy of his free credit report (https://www.annualcreditreport.com) from all three reporting bureaus. He can review the judgment himself and, most importantly, dispute it online with a few clicks. If the creditor fails to reply to the dispute with a set time period (30-60 days, I believe), the judgment will be removed.



Your second option is to have your fiance contact the Legal Services Office onbase (JAG). You are correct that he is protected under the CRA. This act mostly covers Soldiers and Sailors as they are entering Active Duty, so Reservists and new recruits can reap the most benefits of it. Using this line of approach, however, your husband will most likely still have to pay the $1032, but at least the judgment would be removed.



Your third option, if Yahoo! does not censor my response, is to have him apply through a military-friendly bank. USAA, for instance, was founded by military members and ONLY military members and their dependents may join (www.USAA.com). Since banks like these cater to military members, they are used to seeing cases like these and are more willing to make exceptions. Also, these banks tend to go above and beyond the USSCRA (ask USAA yourself what they would do to your fiancee%26#039;s credit cards ANYTIME he PCSs to another duty station).



1 and 2 will take the most time. Option 3 is probably your best bet.

you sure theres nothing else? maybe his age or the fact hes single that the mortgage company is withholding the loan? my husband and i have way more old debt than that from our ex spouses and we qualify for a VA loan, already put the paperwork through.....they said bad credit only affected the percentage rate and the loan limit.

i think the judgement will stand...it is for soldiers and sailors..but its more for when they are deployed not stateside...i dont think its illegal to render a judgement against someone on active duty for any amount either..there are some bums in the military...the best thing to do is to pay it off..and go from there...the faster you pay it off the faster it comes off and the faster you can buy a house..
