In new york state if I was to die and carried unsecured credit card debt would my wife be responsibl

my father has about 40,000 in unsecured credit card debt, the cards are in his name only with no co-signer. he has terminal stomach cancer and is now going to hospice care, he is very worried about this debt. in new york state when he passes away is my mother going to be responsible to pay these cards off? she is on a fixed income with not much assets or resources?? any help would be greatly appreciated

When my wife died (in NY), I wasn%26#039;t responsible for her credit card debt, but it wasn%26#039;t as much as your father%26#039;s. If that%26#039;s spread among a few cards, each company may not bother her for their portion. What they will most likely do is offer to transfer the cards to her name - and that%26#039;s a BIG no-no! They%26#039;ll transfer the debt too, which they won%26#039;t mention until it%26#039;s too late. She should just thank them and tell them that it%26#039;s really kind of them to offer, but she%26#039;s really not interested - then hang up. (Assuming she doesn%26#039;t screen her calls and not answer those calls.)
