I was sued by GE Money bank for my defunct walmart credit card for approx $750, I made arrangements to pay the lawyer half of what I owed, they were supposed to deduct the 2nd half from my checking account in 30 days. They didnt%26#039;, I received a letter from the court stating I had to appear , but I assumed I had taken care of it with the attorney, so I ignored it, Now I just recieved a letter saturday, dated 1-8-08, I received it 1-26-08, stating there is a warrant out for my arrest due to civil contempt of court and they can arrest me on sight at home or at work at any time... What do I do, I am very scared, can I call the court today,not wait until next week and handle this, I don%26#039;t want them to come to my house and arrest me with my kids here,

CALL AS SOON AS THEY OPEN. AS you now know, it%26#039;s never a good idea to assume you can ignore a request to appear. Odds are you can just go in , pay a small fine, point out the details of the solution and unless the CC company is determined to get a judgement on record, be done with it.

If you didn%26#039;t pay the attorney anything yet, you defaulted and will have to appear in court.

However, if you paid the attorney what you agreed to, do you have proof of that? Without proof you have no defense unless you have the attorney appear with you in court.

They probably wont come looking for you. PROBABLY. But in my experience these things are time sensitive and the more you communicate with the court the better off you will be. This can/will follow you forever and get bigger and bigger if you dont take care of it now. Dont be scared. They wont come get you if you make court arrangements with them a.s.a.p. The scariest part is the court appearance (if u have one) and its all pretty minor if you take care of it now. Talk to them, explain your side, they will be happy you did and so will you. When it comes to court you should have checked with your lawyer. Call and find out what is going on. That is the only thing I can tell you.

You can%26#039;t get arrested for a debt, but you most likely lost the case and the judge may order a garnishment of wages.

Contact the court that sent you the warrant several times people have arrest warrants that are not issued unless you are caught for a traffic violation. And explain to them what was suppose to happen and what did happen and then ask them what you should do to clear this mess up.

also when you decide to go to court, go there first with the letter before turning yourself in to the cops and take the envelope as well were the date of the letter is stamped also talk to your lawyer and find out everything that probably got misunderstood. and importantly pay at least a little more then you were supposed to pay on the 8th.

Just because you agreed to a settlement, it has to be official with the courts%26#039; blessing.

Call the court clerk ASAP. They%26#039;ll advise you. I doubt they%26#039;ll come looking for you, but if you get pulled over in your car, you%26#039;ll be going to jail.

Expect a fine, and additional court costs because of this.

You are in serious hot water and better get another lawyer to represent you.
