I pay child support. A portion of that money is half of our childs daycare. Is it legal for the other parent to be recognized as recieveing full credit as the payer of the childcare and recieving a portion of that back through some type of program without the other parent knowing, or also reping that benefit?
Dependent care benefits?
Only the custodial parent can get the tax credit for dependent care. The credit will reduce taxes owed, it will not pay out dollars.
If you paid the daycare directly, you would not get any tax credit for it and it would reduce the other parent%26#039;s tax credit.
What the custodial parent is doing is OK as far as federal income taxes are concerned.
Dependent care benefits?
Only the castodial parent has rights to deduct. However, this parent can deduct ONLY the amount ACTUALLY paid, not the full cost of childcare
